America's Most Smartest Model: Andre Birleanu's Legal Troubles
“Purged” model Mandy Lynn recently gave a little insight into her time on America's Most Smartest Model, and had this to say about Andre Birleanu: “for the most part he is the aggressive, opinionated guy [you] see on the show that is not an act.”

Well, it now a woman is alleging that his “aggressive” behavior crossed the line from annoying to actual assault, and Andre now finds himself in some potentially serious trouble.

He has been charged with sexual misconduct and aggravated harassment due to accusations from a 19-year-old actress.

She gave her account of the events to The New York Post, saying, the two were at a Manhattan fashion party when the incident occurred. "He grabbed me inappropriately…He touched my genitalia, and I immediately moved away." Then I looked over, and he looked really upset . . . I went up to him. And he was standing there with his head down. He said something along the lines of 'no.' He then grabbed my boob."

Andre's public – and weird – response was "I didn't molest anyone . . . I already slept with that girl, so it's strange she would say I touched her inappropriately."

The accuser confirms what Mandy Lynn has said – Andre's volatile personality is no act. "He's just a very, very scary, intimidating person," she said. "He's so explosive. You can see it in his eyes. He has this insane thing inside of him."

This is far from the America's Most Smartest Model contestant's first run-in with the law. The Post also reports that law enforcement sources have said that he “has served a half-dozen prison stints since 2000 on charges including assault, harassment, criminal contempt, criminal mischief and trespassing.”

One recent incident included an accusation of harassment and stalking. In this case, the accuser claimed that he left her “menacing messages,” grabbing her hair and threatening to break her legs.

And in 2003, he served 6-months in jail for harassment, contempt and assault.

While he has yet to be found guilty of the other charges, the fact that he has done time for a crime involving harassment and violence really makes one wonder what kind of screening process the producers did for America's Most Smartest Model? One would think - aside from any sense of responsibility for the safety and well-being of his housemates - that VH1 would have wanted to avoid the potential liability of bringing someone with a legally-documented history of violence into the house.  But I suppose if having a rap sheet were a disqualifying factor, some of the less-savory reality fare on VH1 might have trouble finding a cast.

Right now, he is currently out on bail – posted by his agent. He's using a Legal Aid Society lawyer – a resource for clients who can't afford a lawyer, mainly, apparently, because he says "it takes a lot of paperwork” to hire his own.
