Why is Richard Hatch not in the Heroes vs Villians?

He was asked and he accepted, but the courts banned him from participating because he's still under house arrest. He petitioned. They said no.

I think they still should have let him play. It would have been a much better game with him and Russell against each other.

Plus he might make enough money to pay his taxes. The guy must be a real loose cannon to stay in trouble with the IRS. You have more rights if you kill someone, then if you cheat the IRS. It would be ironic if Survivor sent him to some country that he could not be extradited from.
