Andre Birleanu not only made a name for himself as one of the contestants of VH1's America's Most Smartest Model, but also for allegedly molesting a 19-year-old actress during a party last October at Cipriani Downtown, an upscale Manhattan restaurant.  Now, he is once again the subject of the media as harassment charges against the reality TV star turned model have now been dropped by the New York DA's office, according to gawker.com.

After the young actress filed a formal complaint against the 25-year-old America's Most Smartest Model contestant, Birleanu was arrested and charged with sexual misconduct and aggravated harassment.

"He's just a very, very scary, intimidating person," his accuser told the New York Post at the time. "He's so explosive.  You can see it in his eyes."

"He touched my genitalia and I immediately moved away," she explained.  "Then I looked over, and he looked really upset.... I went up to him.  And he was standing there with his head down.  He said something along the lines of 'no.'  He then grabbed my boob."

In his own defense, Birleanu denied that he molested the actress and maintained that “he already slept with the girl so it would be strange to say the [he] touched her inappropriately.”  At the time of his arrest, he got out of jail on $3,500 bail.

This wasn't the first time Birleanu had been arrested.  In fact, the America's Most Smartest Model contestant had already served several prison stints since 2000 on charges including assault, harassment, criminal contempt, criminal mischief and trespassing, and law enforcement.

Birleanu joined the first season of America's Most Smartest Model, the show that attempts to find brains behind beauty in a series of challenges and will grant the winner $100,000 and, of course, the title of America's Most Smartest Model.  During the competition, he earned a reputation for being hotheaded on the Ben Stein-hosted show but managed to make it all the way to the finals.  Ultimately, he was defeated by VJ Logan, who won the grand prize as well as a V05 ad campaign.
